NOTIFICATION OF OPEN BURNING

Please complete the fields below and submit the form.  A permit reference number will be assigned and emailed to you.  To pay the $20 (regular) permit fee by cheque or credit card you must use the burning permit reference number as the account reference. The fee paid by cheque, for the Burning Permit can also be sent to the District of Lake Country by regular mail or left in the drop box at the front entrance to Municipal Hall. Permit holders also can pay by credit card online through the Option Pay third party secure credit card transaction service.  NOTE: the burning permit reference number must be noted with the payment. The Burning Permit does NOT become valid until the payment is processed. 

  • The burning period ends April 30, 2023 (unless otherwise announced by the Fire Chief). 
  • The maximum size of burn is 2 meters in height by 3 meters in diameter.  You must have a minimum lot size of 1 hectare (2.5 acres) for your permit to be approved.
  • You must also comply with provincial burning regulations brought into effect in 2019. 
  • Each day before you burn, you must phone the Open Burning Hotline at 1-855-262-2876 to check if burning is allowed.

By submitting this Notification of Open Burning, you confirm:

  • All information is correct
  • Payment must be received before the Burning Permit is valid
  • Each day before you burn, you will phone the Open Burning Hotline at 1-855-262-2876 to check if burning is allowed.
  • You have read and understood all regulations, requirements, prohibitions and conditions listed below, especially noting the use of fire extinguishing equipment at the burn site, and agree to be bound by all provisions.
  • You are aware of, and understand, the Provincial Open Burning Smoke Control Regulation, in effect September 15, 2019. 

GENERAL REGULATIONS AND PROHIBITIONS

  1. All persons conducting “Open Burning” under the provisions of Burning Bylaw 612, must submit this Notification of Open Burning.
  2. No person shall conduct open burning except during a permitted open burning period.
  3. No person shall conduct open burning on land of which the person is not the owner or occupier unless authorized to do so by the owner or occupier.
  4. No person shall conduct open burning of any materials except permitted burning materials. Without restricting the generality of the foregoing, no person shall burn garbage, compostable materials or prohibited materials.
  5. No person shall conduct open burning by use of an incinerator, burning barrel, outdoor fireplace with a flue or similar device.
  6. All owners and occupiers of property on which burning is permitted in accordance with Burning Bylaw 612, 2007 shall ensure no nuisance or hazard is caused by any open burning.
  7. No person shall conduct open burning of the wood, trees, stumps, shrubbery and woody debris that results from clearing land that is the subject of a rezoning, subdivision, development permit or soil permit application to help prepare the land for a different land use or density.

OPEN BURNING REQUIREMENTS AND PROHIBITIONS

  1. All permitted burning materials shall be thoroughly dried and capable of being burned and disposed of rapidly.
  2. All permitted burning materials shall originate from the parcel of land where the burn is taking place.
  3. All fires shall be continuously controlled and supervised by a competent person properly equipped with sufficient fire extinguishing equipment and material and shall be maintained so as to not constitute a hazard.
  4. No fire shall be larger than 2 meters in height by 3 meters in diameter.
  5. Burning shall not be commenced unless the Environment Canada venting index indicates that ventilation and air quality are in the “GOOD” category.

 

“Open Burning” means the combustion or burning of any substance in the open air by any means but shall not include:

  • the operation of an outdoor barbeque intended for and used solely for the preparation of foods;
  • fires used by Fire Department authorities for the purpose of education, training and other Fire Department purposes;
  • campfires.

“Prohibited materials” means those materials listed in Schedule A of the Open Burning Smoke Control Regulation enacted pursuant to the Waste Management Act as amended from time to time.

INSPECTIONS AND ORDERS

The Fire Chief or Bylaw Enforcement Officer may withhold, suspend or cancel any burning where that burning creates a hazard or nuisance to persons or property and the Fire Chief or Bylaw Enforcement Officer may order the extinguishment of any fire that causes a hazard or nuisance.


Effective September 15, 2019, the Province put into effect a new Open Burning Smoke Control Regulation. Open Burning is subject to the conditions set out within this new regulation, in addition to District of Lake Country Burning Bylaw 612, 2007. This Notification of Open Burning provides only for the conditions of local bylaw and does not ensure or suggest compliance with the new Provincial regulation. Inspections by Lake Country Fire Department staff will be for the purposes of compliance with Burning Bylaw 612, 2007. It is the responsibility of the permit holder to ensure compliance with the  Provincial regulation. Any noncompliance with the Provincial regulation may be subject to enforcement by the Province.

Note: Open burning starts not earlier than 1 hour after sunrise and ends by 4pm or two hours before sunset, whichever is later, on the same day as open burning starts.
