OUTDOOR EVENT APPLICATION

If your event is being held on the Okanagan Rail Trail it must comply with the ORT Event Principles.  Casual Use Events do not require any event permits if they comply with the ORT Casual Use Guidelines and meet the following criteria:

  1. Event happens solely within the District of Lake Country boundaries;
  2. Less than 100 participants, and
  3. Events do not require District services ie: parking lots, road closures or additional amenities. 

All other outdoor events in Lake Country require a Outdoor Event Permit.

  • This application must be submitted 16 weeks prior to the event. Insurance, electrical permit, Business Licence, and other supporting documents due minimum of 60 days prior.   Consideration will be given to shorter timelines on a case-by-case basis.
  • Events may take place between 7:00 a.m. and 10:00 p.m. only.
  • Maximum 500 patrons per event. Consideration will be given to larger groups, noting there are additional charges and requirements, e.g. RCMP or security, at the appplicant’s expense.
  • Facility booking times/availabilty may vary.

PARKING REQUIREMENTS

Courtesy tows are the responsibility of the organizer and at the organizer’s expense.  Organizer is responsible for ensuring process for informing public of tows and locations is in place (ie. notification of RCMP, etc.)

Will there be security on site?
If event set up takes place the day before the event, will overnight security personnel be on site?

ALCOHOL

Local government approval is required if a Special Occasion Licence is in effect; see Conditions of Permit.  See: Province of BC Apply for a Special Event Permit

FOOD SERVICE

Organizer is responsible for ensuring all food service and/or mobile food vendors on site have valid permits to operate from Interior Health Authority (IHA) and Fire Department, and hold an appropriate Lake Country business licence.

  • IHA Approved Mobile Vending Listing available upon request.
  • Fire Department approval will be facilitated through this application. IHA approvals are done through IHA.

CONDITIONS OF PERMIT

FEES: Facility rental, insurance, security and Liquor Special Event Permit Fees may be applicable. Any costs incurred for damages to District facilities/infrastructure as well as any additional fees incurred during or after the event such as (but not limited to) additional RCMP, Bylaw Officer etc. are payable by the applicant.  The Permit Holder will be responsible for costs due to any damage caused by their subcontractors. 

PRIME CONTRACTOR: As mandated by WorkSafe BC, a designated Prime Contractor is required when there are two or more workers on the job/event site to ensure the health and safety of all workers. If necessary, the permit holder may be required to enter into a Prime Contractor Agreement.

INSURANCE CLAUSE: The Permit Holder shall, without limiting its obligations or liabilities under this Permit/Contract, procure and maintain, at its own expense and cost, the insurance policies and fulfill the requirements attached hereto and made a part hereof. The insurance policies/requirements shall be maintained continuously from commencement of the Permit, Contract or Event hereunder until total completion of the Permit, Contract or Event or such longer period.

HOLD HARMLESS AND INDEMINIFCATION: The Permit Holder shall be liable for all loss, costs, damages, and expenses whatsoever incurred or suffered by the District, its elected officials, officers, employees and agents (the Indemnitees) including but not limited to damage to or loss of property and loss of use thereof, and injury to or death of a person or persons resulting from or in connection with the performance, purported performance, or non-performance of this permit/contract, excepting only where such loss, costs, damages and expenses are as a result of the sole negligence of the Indemnitees. 

The Permit Holder shall defend, indemnify and save harmless the Indemnitees from and against all claims, demands, actions, proceedings, and liabilities whatsoever and all costs and expenses incurred in connection therewith and resulting from the performance, purported performance, or non-performance of this permit/contract, excepting only where such claim, demand, action, proceeding or liability is based on the sole negligence of the Indemnitees. 

USE OF PUBLIC PARKS:  No vehicle access to fields without prior approval.  No ground-penetrating staking permitted for any temporary structures. In the event this agreement is for the use of a park or playing field, there shall be no play where the combination of excess moisture and player usage may cause damage.   

FACILITY MODIFICATIONS: The Permit Holder shall not construct, erect, attach or cause or permit to be constructed, erected or attached any device, fixture, sign, fence or other thing of whatsoever nature to any part of a District facility without the prior written consent from the District. 

CONCESSIONS: It is expressly understood that the District shall have the sole and exclusive right to operate or lease out all concessions in or on a District facility and shall have the sole and exclusive photography, radio, television and recording rights with respect to the use of a District facility by the Licensee. 

LITTER CONTROL: Permit Holders are responsible for collection of litter generated by their event. 

SANITARY & STORM DRAINAGE PROTECTION: Permit Holder may be required to make arrangements for protection of sanitary and storm drains. 

REMOVAL OF GOODS & CHATTELS: The Permit Holder undertakes and agrees to remove all the goods and chattels of the Permit Holder on or before the termination of this agreement. In the event that the Permit Holder fails to remove such goods and chattels as aforesaid, the District may remove and store goods and chattels at the expense of the Permit Holder and the District shall not be liable for any damage to or loss of the said goods and chattels during such removal or storage, or both. All equipment, displays, moneys and other goods and chattels of the Licensee brought onto or into the District facility shall be the sole responsibility of the Permit Holder and the District shall not be liable for any damage to or loss of such equipment, displays, moneys and other goods and chattels from any cause whatsoever. 

RIGHT OF ENTRY: The Permit Holder agrees that access to the facility/park must be granted to personnel required to conduct site inspections and may include but is not limited to District staff, Fire Department staff, BC Ambulance, Interior Health Authority, BC Safety Authority & BC Liquor and Cannabis Regulation Branch (LCRB). Personnel must provide adequate identification to access the site. Personnel will be entitled to enter upon and inspect the District facility/park and to make such alterations, repairs or additions as may be necessary for the safety and preservation of the facility/park and public. 

ALCOHOL: Licensed functions must be approved by the District of Lake Country before obtaining a liquor permit from the RCMP or any other permit-issuing agency. Consumption is restricted to designated areas. The licence holder must comply with all guidelines and any designated driver awareness programs. 

FOOD VENDORS: All food vendors are required to have a drop cloth covering the surface under their entire operation. It is the organizer’s responsibility to enforce these requirements or be charged the potential cost of power washing the surface. Grease or grey water disposal units must be provided for all food services on site. All food services must be informed that grease may not be poured down sinks, toilets or storm drains. Disposal units must be easily available to all food service providers. All food service on site must have Interior Health Authority approval and mobile food trucks must also have Fire Department approval.  Food vendors must have valid District business licences.  New business licence applications require 4-5 weeks’ processing time. 

NOTIFICATION OF NEIGHBOURS: At the discretion of the District, Permit Holders may be required to notify affected neighbours (residents & businesses) who may be affected by the event at their own cost, and provide verification to the District that this has been done. 

POLICING COSTS: Events that require police resources may only be provided on an overtime basis. If extra police resources from other RCMP detachments are required, the permit holder must pay 100% of these additional costs which may include overtime, travel, meals, accommodation and other incidental costs. 

TRAFFIC AND PARKING CONTROL:         

  • Permit Holders are required to provide sufficient certified Traffic Control Persons, Traffic Marshals and barriers to ensure traffic safety is met as required and instructed by Engineering and Environmental Services.
  • Traffic Marshals and Traffic Control Persons are required to wear a reflective vest at all times. These vests must be supplied by the Permit Holders of the event. All marshals must be at least 16 years of age.
  • Traffic direction within an intersection is only permitted to be done by a Peace Officer appointed under the provisions of the Provincial Motor Vehicle Act. No other person is permitted to direct traffic in a signalized intersection. All other stopping or re-routing of traffic and street closures may be done by certified traffic control persons. RCMP is required to control traffic at signalized intersections.
  • Requests to use Highway 97 must be made to the Ministry of Transportation and Infrastructure.

ADVERTISING: No person shall publicize or advertise an event before a permit for the event has been issued or without written permission. 

COMPLIANCE WITH LAWS: Permit Holder must comply with all applicable Federal, Provincial, and/or District laws, regulations and bylaws.  

NOTICE OF COLLECTION OF PERSONAL INFORMATION: Personal information provided to the District of Lake Country is collected, used and disclosed in accordance with the Freedom of Information and Protection of Privacy Act (FOIPPA). Personal information is defined as recorded information about an identifiable individual, including name, phone number, or email address, and is obtained if supplied voluntarily through completing an application for a District program or service. Any personal information we ask you to provide will only be used for that purpose. Questions may be directed to the Freedom of Information head for the District of Lake Country. 

The Permit Holder has read, acknowledges, agrees, understands and will comply with the above-noted Conditions of Permit.

Completed Outdoor Event Application Forms will undergo an initial review by
Lake Country staff within 10 business days of submission.
